If you do not agree with any part of these Terms, you must discontinue the use of our Services immediately.

2. SCOPE OF SERVICES

ScentPocket is an online retailer specializing in fragrance decants and samples. Our Services are intended for personal use only and may not be used for resale, distribution, or any unauthorized commercial purposes. We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable for any modifications, suspensions, or discontinuations of the Services.

3. ELIGIBILITY & ACCOUNT RESPONSIBILITY

By using our Services, you represent and warrant that:

  • You are at least 18 years of age, or if under 18, you have obtained legal parental or guardian consent.

  • You have the legal capacity to enter into a binding contract.

  • You will not use our Services for any illegal or unauthorized purpose.

  • You are responsible for maintaining the confidentiality of your account credentials and all activities conducted under your account.

  • We reserve the right to terminate accounts suspected of fraudulent, abusive, or unauthorized use.

4. ORDERS, PRICING & PAYMENTS

4.1 ORDER ACCEPTANCE & CANCELLATION

All orders placed through our Site are subject to acceptance by ScentPocket. We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases where:

  • Fraudulent or suspicious activity is detected.

  • The product is out of stock.

  • Billing or shipping information is incomplete or unverifiable.

  • In the event of a cancellation, we will notify you and issue a refund if payment has been processed.

4.2 PRICING & PAYMENT PROCESSING

  • All prices are listed in U.S. Dollars (USD) and are subject to change without prior notice.

  • Payments must be made at checkout using one of our accepted payment methods.

  • By completing a purchase, you authorize us to charge the provided payment method for the full order amount, including applicable taxes and shipping fees.

5. SHIPPING & DELIVERY

  • We strive to process and ship orders promptly, but we do not guarantee delivery timelines.

  • ScentPocket is not responsible for:

    • Delays caused by carriers or external factors beyond our control.

    • Orders lost due to incorrect shipping information provided by the Customer.

    • Packages marked as "Delivered" by the carrier but not received by the Customer.

  • If a package is lost in transit and is not marked as "Delivered," please contact us at scentpocketbusiness@gmail.com for assistance.

6. NO REFUNDS, NO RETURNS

  • Due to the nature of our products, all sales are final. We do not accept returns or offer refunds for any reason except in the case of an order fulfillment error.

  • Refunds will only be granted under the following conditions:

    • You receive a product that differs from the one ordered.

    • You notify us within 7 days of delivery and provide photographic evidence of the incorrect item.

  • If a refund or replacement is approved, ScentPocket will cover the cost of return shipping. Otherwise, all shipping costs are non-refundable.

  • Chargeback Protection: Any attempts to dispute transactions through chargebacks or payment reversals in violation of this policy may result in legal action and account termination.

7. PRIVACY & DATA PROTECTION

  • Your use of our Services is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information.

  • By using our Services, you consent to the collection and processing of your data as outlined in the Privacy Policy.

  • While we take reasonable measures to secure your data, we cannot guarantee absolute security against cyber threats or unauthorized access.

To the fullest extent permitted by law, ScentPocket shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from your use of our Services.

  • Any personal reactions, skin allergies, or dissatisfaction with the fragrances purchased.

  • Any loss or damage resulting from circumstances beyond our reasonable control, including but not limited to shipping delays, theft, or third-party service failures.

  • Our liability, in any case, shall not exceed the amount paid for the specific order in question.

10. PROHIBITED CONDUCT

You may not use our Services to:

  • Engage in fraudulent transactions.

  • Misrepresent your identity or payment information.

  • Distribute malware, spam, or any disruptive content.

  • Attempt to gain unauthorized access to our systems or data.

  • Violate any applicable laws, rules, or regulations.

  • Violation of these terms may result in immediate termination of access to our Services and potential legal action.

11. TERMINATION & SUSPENSION

  • We reserve the right to terminate or suspend access to our Services at any time if we believe you have violated these Terms or engaged in conduct that may harm ScentPocket or its customers.

12. GOVERNING LAW & DISPUTE RESOLUTION

  • These Terms are governed by the laws of the state in which ScentPocket operates.

  • Any disputes shall be resolved through arbitration or in a court of competent jurisdiction in that state.

  • We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Effective Date."

  • Your continued use of the Services constitutes acceptance of any modifications.
